Terms and Conditions

1. Who we are

“The Brick Smiths” (ABN:  20 976 931 412), based in Victoria, Australia, provides LEGO® Serious Play® (LSP) workshops and related services (we, us, our). You are the website visitor or client (you, your).


2. Using this website

By using this site or making a booking/enquiry, you agree to these Terms. We may update them at any time by posting a new version here.


3. Enquiries, bookings and proposals

  • Discovery calls: Informal chats are for exploring your needs; they’re not legal, financial or HR advice.
     
  • Workshop bookings: Dates are confirmed once you accept our written quote/proposal and (if applicable) pay any required deposit.
     
  • Time zone: We operate in Melbourne time (AEST/AEDT).
     
  • Changes & rescheduling: Let us know as early as possible. We’ll act reasonably to accommodate changes.
     

4. Pricing, deposits and payment

  • Quotes: Unless stated otherwise, quotes are in AUD and exclude GST.
     
  • Deposit: A non-refundable deposit of 50% may be required to secure dates. Balance is due 7 days before delivery (or as stated on the invoice).
     
  • Expenses: Pre-approved travel, venue, materials and other out-of-pocket costs will be itemised and invoiced.
     
  • Late payment: We may charge reasonable admin/interest for overdue amounts and pause work until payment is received.
     

5. Cancellations, Rescheduling & Refunds 

 

Bookings & payment

  • Prices are in AUD; GST (if applicable) will be shown on your invoice/checkout.
     
  • Payment method is confirmed in your proposal (invoice/EFT or secure online checkout).
     
  • Dates are secured once you accept our proposal and complete the required payment.
     

Cancellations by the client

  • 14+ days before the session: Full refund (or free reschedule).
     
  • 7–13 days before: 50% refund (or one free reschedule).
     
  • <7 days before: Non-refundable; we may offer a reschedule at our discretion.
     

Rescheduling by the client

  • One free reschedule with 7+ days’ notice. Further reschedules may incur a reasonable fee reflecting our costs.
     

No-shows

  • If participants do not attend at the scheduled time, the session is deemed delivered and no refund applies.
     

Cancellations / rescheduling by us

  • We may reschedule due to illness, emergencies or events beyond our control. If we can’t offer a reasonable alternative date, you’ll receive a refund of fees paid for that session (excluding any third-party costs you pre-approved that are not recoverable).
     

Customisation, venues & materials

  • For workshops requiring custom design, venue hire, or advance purchase of LEGO® kits/materials, specific terms will be set out in your proposal. Non-recoverable third-party costs may be deducted from refunds where applicable.
     

Online sessions

  • Clients are responsible for stable internet and any specified equipment (e.g., LEGO® Serious Play® Starter Kits per participant). We can’t refund for technical issues outside our control.
     

Your rights under the ACL

  • Nothing in this policy limits your consumer guarantees under the Australian Consumer Law (e.g., if services are not provided with due care and skill or as agreed). Our policy applies to change-of-mind and late-change scenarios and must be read together with your statutory rights.
     

6. Your responsibilities (workshops)

  • Venue & safety: You’ll ensure a safe venue with adequate space, tables, chairs and accessibility. You’re responsible for your participants’ conduct and safety at your premises/events.
     
  • Tech & materials: We’ll outline any required AV, room setup and materials in advance.
     
  • Recording & photos: We won’t record or photograph participants without consent (see Privacy Policy).
     

7. Intellectual property

  • Our materials: Slides, guides and methods we provide remain our IP. We grant you a non-exclusive, non-transferable licence to use workshop outputs and handouts internally for your team’s learning. You must not reproduce, publish or commercialise our materials without written permission.
     
  • Your materials: You retain ownership of content and data you supply to us.
     

8. Confidentiality

Each party must keep the other party’s non-public information confidential, and only use it to deliver or receive the services, unless disclosure is required by law.


9. Warranties and the Australian Consumer Law (ACL)

We provide services with due care and skill. Nothing in these Terms excludes, restricts or modifies any consumer guarantees under the ACL that cannot be excluded. Subject to the ACL, we do not guarantee specific outcomes.


10. Liability

To the extent permitted by law, our aggregate liability for any claim connected to the services is limited to the fees you paid to us for the relevant services in the 12 months before the claim. We’re not liable for indirect or consequential loss (e.g., lost profits, opportunity or data). This clause does not limit liability for personal injury caused by our negligence or for wilful misconduct.


11. Force majeure

Neither party is liable for delay or failure caused by events beyond reasonable control (e.g., extreme weather, power/network outages, government restrictions).


12. Testimonials and logos

You control if and how we use your testimonials, photos or logos. We’ll only publish them with your prior written consent.


13. Changes to services and this site

We may update services, pricing, availability and site content at any time.


14. Governing law

These Terms are governed by the laws of Victoria, Australia. The parties submit to the exclusive jurisdiction of its courts.
